In compliance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (hereinafter the "Law"), its Regulations and other applicable provisions, and with the purpose of allowing you to decide in an informed manner about the treatment that we must and may give to your personal data, we make available this notice that provides information about the use of your personal data, identifying the entity responsible for your information, the purposes or actions that motivate the collection, use and custody of your personal data; the third parties to whom your personal data will or may be transferred; the mechanisms for you to exercise your rights, among other information.

 

Who is responsible for your personal data?

 

Bona Terra, A.C., (hereinafter and indistinctly the "Responsible" or "Universidad Panamericana") is the Responsible for your personal data. Our address to hear and receive notifications is: Av. What data do we use and can we request?

 

In order to fulfill the purposes stated in this Notice, Universidad Panamericana must or may process the following categories of personal data:

 

  • Identification and contact information;
  • Academic and professional data;
  • Employment data;
  • Economic, financial and insurance data;
  • Sensitive data.

 

Do we request sensitive data?

 

In order to comply with legal provisions regarding social security and labor matters; management actions of benefits granted by Universidad Panamericana; carrying out medical and health questionnaires; and applying and performing medical and toxicological exams, we must treat sensitive personal data. When we must request this information, we will obtain your express written consent, through the corresponding physical or electronic means.

 

Personal data of third parties

 

If you provide to Universidad Panamericana personal data of third parties (for example, data of family members) for the fulfillment of the purposes identified in this Privacy Notice, you must inform them about the existence of the processing of their personal data and the content of this Privacy Notice. If you provide personal data of third parties, by providing such data, you represent that you have the consent of their owners to provide their information to Universidad Panamericana or that you are doing so in compliance with a legal obligation and that such data are correct and complete.

 

Personal data of minors

 

For the purposes set forth in this Privacy Notice, Universidad Panamericana does not personally collect data from minors (individuals under 18 years of age). The Universidad Panamericana will only process personal data of minors provided by their parents and/or guardians for purposes related to the employment relationship between you and the Universidad Panamericana, including, where appropriate, the management of employment benefits.

 

Parents and/or guardians may at any time exercise their ARCO Rights on behalf of their children or guardians, or revoke their consent to the processing of the personal data they have provided to Universidad Panamericana for the aforementioned purposes, in those cases where current legislation so permits.

 

Purposes of the processing of personal data

 

The Universidad Panamericana will or may process your personal data for the following types of purposes:

 

Primary purposes:

 

  1. Management, control and administration of employee files.
  2. Management, control and administration of payroll.
  3. Management, control and administration of benefit payments, benefits, bonuses, reimbursements, pensions and/or insurance.
  4. For the registration of insurance for employees and/or their family members, life insurance, major medical insurance and for the designation of beneficiaries in life insurance.
  5. Management, control and administration of access to Universidad Panamericana facilities.
  6. Management, control and administration of procedures related to insurance provided to employees.
  7. Management control and administration of the designation of computer equipment, e-mail and access to systems.
  8. Management, control and administration of internal audits of Universidad Panamericana.
  9. Management of requests for available vacancies to collaborators.
  10. Monitoring of the proper and lawful use of the IT resources of Universidad Panamericana and performance evaluations, through internal procedures and proprietary and/or third-party technological tools.
  11. Contact your family members, economic dependents and/or beneficiaries in case of emergency.
  12. To carry out all the necessary termination procedures at the end of the employment relationship.
  13. If applicable, application of medical or toxicological examinations.
  14. If applicable, investigation of complaints or denunciations.
  15. If applicable, to issue labor certificates once the legal relationship with you has ended.
  16. Historical and statistical record of collaborators.

 

The following purposes are considered secondary and, therefore, you must consent to our processing of your personal data for:

 

  1. Communication of activities and events to promote and improve the integration of Universidad Panamericana employees.
  2. Communication of non-work activities for the benefit of our employees or the community.

 

When we collect your personal data, you may indicate through physical or electronic means (such as check boxes) if you do not want Universidad Panamericana to process your data for the secondary purposes set forth in this Notice. If you have had access to this Notice by electronic means or we have obtained your data directly or indirectly, you may express your refusal to the processing of your personal data for secondary purposes within five business days from the date we made this Notice available to you.

 

If you change your mind at any other time, you may object to the processing of your personal data for the secondary purposes indicated above, and even revoke your consent for such purposes. In such cases, you may communicate your decision through the procedure provided in the "ARCO Rights" section of this Privacy Notice.

 

With whom can we share your data?

 

The Universidad Panamericana may transfer your personal data under the terms of the Law and this Privacy Notice, both within and outside Mexico, in the following cases and for the following purposes:

 

  1. To our parent company, affiliates, branches and/or campuses that are part of Universidad Panamericana, and that operate under the same internal processes and policies, for the purposes of management, administration and centralized safekeeping of information, including actions to control registrations, cancellations and updating of data in their files; as well as in compliance with obligations derived from the policies and regulations of Universidad Panamericana; communication of reports, evaluations, reports, internal and external audits to administrative bodies, as well as statistical purposes and historical records of the collaborators of Universidad Panamericana.   2. Banks or other financial institutions, for the fulfillment of payment obligations.
  3. Insurance companies and insurance agents, for the contracting and management of insurance policies in favor of the collaborators who decide to adhere to them.
  4. Service providers, in order for them to support Universidad Panamericana in completing the labor benefits of our employees and/or their families or for the performance of medical examinations, provided that such services require the service provider to keep evidence of the services rendered.
  5. Public agencies; federal, state and/or municipal public administrations; commissions; institutes and/or regulatory entities, for compliance with reporting obligations, transparency and prevention of unlawful activities such as complaints of discrimination, harassment, bullying and gender-based violence, as well as for compliance with judicial or administrative requirements issued by competent authorities.

 

The Law establishes that the aforementioned data transfers do not require your consent in order to be carried out, but Universidad Panamericana is obliged to inform about them. Any transfer of your personal data that does require your consent will be previously informed, through the communication and updating of this Privacy Notice and prior to the realization of such data communication.

 

ARCO Rights

 

The Law regulates the ARCO Rights that you have as a holder of personal data. These rights include:

 

  • Access: the right to know what personal data we process about you, as well as information regarding the conditions and generalities of the processing.
  • Rectification: the right to request, at any time, the rectification of data that is inaccurate or incomplete.
  • Cancellation: the right to stop the processing of your personal data, starting with a blocking and subsequent deletion.
  • Opposition: the right to object, for legitimate reasons, to the processing of your personal data.

 

To exercise any of the ARCO Rights, you must submit a request addressed to our Personal Data Department, through any of the following channels:

 

a) By sending a request to the e-mail ags_derechosarco@up.edu.mx, or

b) Sending a duly signed application to the address Av. José María Escrivá de Balaguer 101, Fraccionamiento Villas Bonaterra, C.P. 20296, Aguascalientes, Ags.

 

The application must contain:

 

  1. Your full name and address, or other means of communicating a response to your request;
  2. Copy of a document proving your identity and, if applicable, legal representation if someone is exercising the right on your behalf. You may omit this requirement if you provide information that proves you as a collaborator of the Responsible Party and identifies you in an indubitable way;
  3. A clear and precise description of the ARCO Right you wish to exercise and the personal data related to your request; and
  4. If applicable, any other information or document that will help us locate your personal data.

 

The Universidad Panamericana will respond to your request within 20 (twenty) business days from the date it is sent and received. If the request is accepted, the Universidad Panamericana will make it effective within 15 (fifteen) working days following the date on which it communicates the response. If the information and/or documentation provided in your request is incomplete, erroneous and/or insufficient, or if the necessary documents to prove your identity or the corresponding legal representation are not provided, Universidad Panamericana will request the correction and correction of the deficiencies in order to process the request. You will have 10 (ten) working days to comply with the requirement and correct the request; otherwise the request will be considered as not submitted.

 

The use of electronic means for the exercise of ARCO Rights authorizes us to respond to the corresponding request through the same means, unless you clearly and expressly indicate another means of contact in your request.

 

The right of cancellation is not absolute. Please note that Universidad Panamericana must retain information to comply with various legal obligations and may share your personal data with other entities or bodies in order to do so. In such cases, the right of erasure may need to be requested from the entity that received your personal data.

 

Do you want to revoke your consent?

 

In some cases, you may revoke your consent to the processing of your personal data; however, this revocation may not have retroactive effects, that is, it may not affect situations, procedures or transfers carried out before the revocation of your consent; nor in cases where such revocation involves the impossibility of fulfilling obligations arising from a legal relationship in force between you and the Universidad Panamericana, or involves the breach of general provisions of public order that establish the obligation to maintain the processing of your personal data for a certain period of time.

Limitations on the use and disclosure of your personal data

 

You may limit the use or disclosure of your personal data by directing the corresponding request to our Personal Data Department, following for such purposes the procedure and instructions applicable to the exercise of the ARCO Rights.

 

Universidad Panamericana has the means and procedures to ensure the inclusion of some of your personal data in its own exclusion lists, to prevent your data from being disclosed. In such cases, the Universidad Panamericana will provide the owners who request their registration with the corresponding registration certificate.

 

Changes to our Privacy Notice

 

The Universidad Panamericana may modify, update, extend and/or otherwise change the content and scope of this Privacy Notice, at any time and under our complete discretion. At any time, you may request the latest version of this Privacy Notice to our Personal Data Department, through the e-mail ags_derechosarco@up.edu.mx, or through the Human Resources Department.

 

When it is legally appropriate and we have your email address, Universidad Panamericana may communicate changes to this Privacy Notice through that means of communication.
