In compliance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (hereinafter the "Law"), its Regulations and other applicable provisions, and with the purpose of allowing you to decide in an informed manner about the treatment that we must and may give to your personal data, we make available this notice that provides information about the use of your personal data, identifying the entity responsible for your information; the purposes or actions that motivate the collection, use and custody of your personal data; the third parties to whom your personal data will or may be transferred; the mechanisms for you to exercise your rights, among other information.

 

Who is responsible for your personal data?

 

Bona Terra, A.C. (hereinafter and indistinctly the "Responsible" or "Universidad Panamericana") is the Responsible for your personal data. Our address to hear and receive notifications is: Av. José María Escrivá de Balaguer 101, Fraccionamiento Villas Bonaterra, C.P. 20296, Aguascalientes, Ags.

 

What data do we use and can we request?

 

Para cumplir con las finalidades informadas en el presente Aviso, la Universidad Panamericana debe o podrá tratar las siguientes categorías de datos personales, relacionados con personas físicas, los representantes legales y/o personas de contacto de personas morales:

 

  • Identification and contact information;
  • Employment data;
  • Financial and/or patrimonial data, and
  • Datos de información comercial.

 

Do we request sensitive data?

 

In order to fulfill the purposes described in this Privacy Notice, Universidad Panamericana will not process sensitive personal data.

 

Personal data of third parties

 

Si Usted entrega a la Universidad Panamericana datos personales de terceros (por ejemplo, referencias personales o comerciales) para el cumplimiento de finalidades identificadas en el presente Aviso de Privacidad, deberá informarles sobre la existencia del tratamiento de sus datos personales y el contenido de este Aviso de Privacidad. Si proporciona datos personales de terceros manifiesta con su entrega que cuenta previamente con el consentimiento de sus titulares para proporcionar su información a la Universidad Panamericana y que los mismos son correctos y completos.

 

Purposes of the processing of personal data

 

The Universidad Panamericana will or may process your personal data for the following purposes:

 

Primary purposes:

 

  1. Gestión, control y administración del proceso de selección y alta de proveedores en los sistemas la Universidad Panamericana.
  2. Administración y gestión para la elaboración de contratos.
  3. En su caso, revisión de documentos de personal de proveedores.
  4. Gestión, control y administración de evaluaciones de calidad de servicios y/o productos de los proveedores conforme a los procedimientos establecidos por la Universidad Panamericana.
  5. Gestión, control y administración de pago de servicios y/o productos proporcionados por proveedores.
  6. Cumplimiento de obligaciones de facturación y pagos relacionados con proveedores.
  7. Gestión, control y administración de los servicios y/o productos adquiridos por la Universidad Panamericana de sus proveedores.
  8. Administración y gestión de documentos de proveedores bajo resguardo de la Universidad Panamericana.
  9. Gestión y control de comunicaciones entre la Universidad Panamericana y sus proveedores.
  10. Estadística y registro histórico de proveedores.

With whom can we share your data?

 

The Universidad Panamericana may transfer your personal data under the terms of the Law and this Privacy Notice, both within and outside Mexico, in the following cases and for the following purposes:

 

  1. Hacia nuestra matriz, afiliadas, sedes y/o campus que formen parte de la Universidad Panamericana, y que operen bajo los mismos procesos y políticas internas, para una gestión centralizada de la información.
  2. Organismos públicos; administraciones públicas federales, estatales y/o municipales; comisiones; institutos, entidades reguladoras; autoridades judiciales o administrativas; entidades gubernamentales nacionales y/o extranjeras, para el cumplimiento de obligaciones informativas, de transparencia y de prevención de actividades ilícitas como fraudes y robos; así como para el cumplimiento de obligaciones contempladas en la legislación aplicable, tratados internacionales y/o en cumplimiento de requerimientos efectuados por aquéllas, incluyendo el cumplimiento de obligaciones legales de información, de requerimientos de información y/o de requerimiento judiciales o administrativos emitidos por autoridades competentes debidamente fundados y motivados.
  3. Bancos u otras entidades financieras, para el cumplimiento de obligaciones de pago.

 

The Law establishes that the aforementioned data transfers do not require your consent in order to be carried out, but Universidad Panamericana is obliged to inform about them. Any transfer of your personal data that does require your consent will be previously informed, through the communication and updating of this Privacy Notice and prior to the realization of such data communication.

 

ARCO Rights

 

The Law regulates the ARCO Rights of the holders of personal data. These rights include:

 

  • Access: the right to know what personal data we process about you, as well as information regarding the conditions and generalities of the processing.
  • Rectification: the right to request, at any time, the rectification of data that is inaccurate or incomplete.
  • Cancellation: the right to stop the processing of your personal data, starting with a blocking and subsequent deletion.
  • Opposition: the right to object, for legitimate reasons, to the processing of your personal data.

 

To exercise any of the ARCO Rights, you must submit a request addressed to our Personal Data Department, through any of the following channels:

 

a) By sending a request to the e-mail ags_derechosarco@up.edu.mx, or

b) Sending a duly signed application to the address Av. José María Escrivá de Balaguer 101, Fraccionamiento Villas Bonaterra, C.P. 20296, Aguascalientes, Ags.

 

The application must contain:

 

  1. Your full name and address, or other means of communicating a response to your request;
  2. Copy of a document proving your identity and, if applicable, legal representation if someone is exercising the right on your behalf. You may omit this requirement if you provide information that proves you as a collaborator of the Responsible Party and identifies you in an indubitable way;
  3. A clear and precise description of the ARCO Right you wish to exercise and the personal data related to your request; and
  4. If applicable, any other information or document that will help us locate your personal data.

 

The Universidad Panamericana will respond to your request within 20 (twenty) business days from the date it is sent and received. If the request is accepted, the Universidad Panamericana will make it effective within 15 (fifteen) working days following the date on which it communicates the response. If the information and/or documentation provided in your request is incomplete, erroneous and/or insufficient, or if the necessary documents to prove your identity or the corresponding legal representation are not provided, Universidad Panamericana will request the correction and correction of the deficiencies in order to process the request. You will have 10 (ten) working days to comply with the requirement and correct the request; otherwise the request will be considered as not submitted.

 

The use of electronic means for the exercise of ARCO Rights authorizes us to respond to the corresponding request through the same means, unless you clearly and expressly indicate another means of contact in your request.

 

The right of cancellation is not absolute. Please note that Universidad Panamericana must retain information to comply with various legal obligations and may share your personal data with other entities or bodies in order to do so. In such cases, the right of erasure may need to be requested from the entity that received your personal data.

 

Do you want to revoke your consent?

 

In some cases, you may revoke your consent to the processing of your personal data; however, this revocation may not have retroactive effects, that is, it may not affect situations, procedures or transfers carried out before the revocation of your consent; nor in cases where such revocation involves the impossibility of fulfilling obligations arising from a legal relationship in force between you and the Universidad Panamericana, or involves the breach of general provisions of public order that establish the obligation to maintain the processing of your personal data for a certain period of time.

Limitations on the use and disclosure of your personal data

 

You may limit the use or disclosure of your personal data by directing the corresponding request to our Personal Data Department, following for such purposes the procedure and instructions applicable to the exercise of the ARCO Rights.

 

Universidad Panamericana has the means and procedures to ensure the inclusion of some of your personal data in its own exclusion lists, to prevent your data from being disclosed. In such cases, the Universidad Panamericana will provide the owners who request their registration with the corresponding registration certificate.

 

Changes to our Privacy Notice

 

La Universidad Panamericana se reserva el derecho de modificar, actualizar, extender y/o de cualquier otra forma cambiar el contenido y alcance de este Aviso de Privacidad, en cualquier momento y bajo completa discreción de la Universidad Panamericana. En todo momento, Usted puede solicitar una copia de la última versión de este Aviso de Privacidad a nuestro Departamento de Datos Personales, a través del correo electrónico ags_derechosarco@up.edu.mx..  Cuando resulte legalmente procedente y contemos con su correo electrónico, Universidad Panamericana podrá comunicar cambios al presente Aviso de Privacidad a través de ese medio de comunicación.
