In compliance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (hereinafter the "Law"), its Regulations and other applicable provisions, and with the purpose of allowing you to decide in an informed manner about the treatment that we must and may give to your personal data, we make available this notice that provides information about the use of your personal data, identifying the entity responsible for your information; the purposes or actions that motivate the collection, use and custody of your personal data; the third parties to whom your personal data will or may be transferred; the mechanisms for you to exercise your rights, among other information.

Do we request sensitive data?

 

The Universidad Panamericana may process the following categories of sensitive personal data for legitimate, specific purposes in accordance with its activities, in relation to the following profiles of data subjects:

 

PARENTS

 

  • Health data, and
  • Data on religious or ideological beliefs.

 

STUDENTS

 

  • Health data, and
  • Data on religious or ideological beliefs.

 

The Universidad Panamericana may request student health information to determine the need for special needs support and to address the health needs of the campus community. The Universidad Panamericana may request religious beliefs for the tailoring of programs and services to support student development and to promote an inclusive and respectful environment.

 

Processing of personal data of children under 18 years of age

 

Occasionally, our university students apply for admission before they reach the age of majority. In such cases, we require their parents or guardians to actively participate in the admissions process, including providing proof of parentage or custody and express written consent to process their children's or guardians' personal information until such time as they are old enough to consent as adults.

 

Third Party Personal Data

 

If you provide to Universidad Panamericana personal data of third parties (for example, personal data of persons from whom personal references may be requested) for the fulfillment of the purposes identified in this Privacy Notice, you must inform them about the existence of the processing of their personal data and the content of this Privacy Notice. If you provide personal data of third parties, you represent with your delivery that you have the consent of their owners to provide their information to Universidad Panamericana or that you do so in compliance with a legal obligation and that they are correct and complete.

 

Purposes of the processing of personal data

 

The Universidad Panamericana will or may process your personal data for the following primary purposes, according to the profile of the personal data subject concerned:

 

PARENTS

 

  1. Validate your information and documentation.
  2. Contact you through various means of physical and electronic communication such as instant messaging services, e-mail, telephone calls and communication technology platforms.
  3. If applicable, request your participation and provide you with the educational services offered by Universidad Panamericana in courses, workshops or training programs for mothers, fathers or married couples.
  4. Where appropriate, to provide religious support and counseling to parents or guardians who request it.
  5. If applicable, for the realization of virtual classes in technological communication platforms.
  6. Receive payments, issue payment vouchers, account statements, as well as document and carry out collection procedures in case of debt.

 

STUDENTS

 

  1. Validate your information and documentation.
  2. Register him/her at Universidad Panamericana, register him/her in our systems, integrate his/her academic record, and issue his/her student credential.
  3. Provide information and educational services offered by Universidad Panamericana, according to the academic program to which he/she is enrolled, as well as contact him/her in relation to the administrative procedures corresponding to his/her studies.
  4. To control vehicular access.
  5. Invitation and, where appropriate, registration to participate in extracurricular activities in order to contribute to your comprehensive education.
  6. Contact you in relation to academic, cultural, sporting, or religious activities in which you participate, have participated, or are interested in participating.
  7. Lending you material for academic and extracurricular activities.
  8. Provide academic support with technological tools.
  9. Create a directory of students.
  10. To know their profile in order to develop didactic strategies, provide counseling and keep track of them.
  11. Provide psycho-pedagogical support.
  12. Follow up on their academic progress.
  13. Perform administrative and school services.
  14. Practice, record and review your evaluations.
  15. To store and check your grades and academic history.
  16. Prepare and file your medical records to prevent contingencies and provide you with support in case you have special health needs, as well as provide you with medical care.
  17. So that the realization of virtual classes in technological platforms of text, voice and video communications with storage for academic continuity.
  18. Contact you through various means of physical and electronic communication such as instant messaging services, email, phone calls and text, voice and video communications technology platforms with storage.
  19. Validate their participation in various publications, collaborations and studies.
  20. Where appropriate, for the adaptation of religious activities and ceremonies at Universidad Panamericana.
  21. Where appropriate, to respect the religious practices of students.
  22. Where appropriate, to provide religious support and counseling to students who request it.
  23. If applicable, for the recruitment, selection and training of the brigade team.

 

The Universidad Panamericana may process your personal data for the following secondary purposes, according to the profile of the personal data subject in question:

 

PARENTS

 

  1. Conducting surveys and obtaining your feedback to improve our services.
  2. Sending promotional information about our academic and cultural offerings.

 

STUDENTS

 

  1. Send them congratulations for their birthday or achievements.
  2. Send you promotional information about our academic and cultural offerings.
  3. Disclose your image and name and, if applicable, academic and employment data for promotional and statistical purposes of Universidad Panamericana.
  4. To request their collaboration for the elaboration of rankings, accreditations, and promotional activities of Universidad Panamericana.
  5. Conduct surveys and obtain your feedback to improve our services.

 

When we collect your personal data, you may indicate through physical or electronic means (such as check boxes) if you do not want Universidad Panamericana to process your data for the secondary purposes set forth in this Notice. If you have had access to this Notice by electronic means or we have obtained your data directly or indirectly, you may express your refusal to the processing of your personal data for secondary purposes within five business days from the date we made this Notice available to you.

 

If you change your mind at any other time, you may object to the processing of your personal data for the secondary purposes indicated above, and even revoke your consent for such purposes. In such cases, you may communicate your decision through the procedure provided in the "ARCO Rights" section of this Privacy Notice.

 

With whom can we share your data?

 

The Universidad Panamericana may transfer your personal data under the terms of the Law and this Privacy Notice, both within and outside Mexico, in the following cases and for the following purposes:

 

  1. To our parent company, affiliates, branches and/or campuses that are part of Universidad Panamericana, and that operate under the same internal processes and policies, in order to comply with the legal relationship we have with you; as well as to comply with the obligations of local regulations; communication of reports, evaluations, reports, internal and external audits to the administrative bodies of Universidad Panamericana, as well as statistical purposes and historical record of the students of Universidad Panamericana.   2. Public agencies; federal, state and/or municipal public administrations; commissions; institutes and/or regulatory entities, for compliance with reporting obligations, transparency and prevention of unlawful activities such as complaints of discrimination, harassment, bullying and gender-based violence, as well as for compliance with judicial or administrative requirements issued by competent authorities.
  3. Universities or study centers, to communicate the evaluations and results of students who participated in internships or programs coordinated by Universidad Panamericana.

 

The Law establishes that the aforementioned data transfers do not require your consent in order to be carried out, but Universidad Panamericana is obliged to inform about them. Any transfer of your personal data that does require your consent will be previously informed, through the communication and updating of this Privacy Notice and prior to the realization of such data communication.

 

ARCO Rights

 

The Law regulates the ARCO Rights of the holders of personal data. These rights include:

 

  • Access: the right to know what personal data we process about you; as well as information regarding the conditions and generalities of the processing.
  • Rectification: the right to request, at any time, the rectification of data that is inaccurate or incomplete.
  • Cancellation: the right to stop the processing of your personal data, starting with a blocking and subsequent deletion.
  • Opposition: the right to object, for legitimate reasons, to the processing of your personal data.

 

To exercise any of the ARCO Rights, you must submit a request addressed to our Personal Data Department, through any of the following channels:

 

a) Sending a request to the e-mail ags_derechosarco@up.edu.mx; or

b) Sending a duly signed application to the following address: Av. José María Escrivá de Balaguer 101, Fraccionamiento Villas Bonaterra, C.P. 20296, Aguascalientes, Ags.

 

The application must contain:

 

  1. Your full name and address, or other means of communicating a response to your request;
  2. Copy of a document proving your identity and, if applicable, legal representation if someone is exercising the right on your behalf.
  3. A clear and precise description of the ARCO Right you wish to exercise and the personal data related to your request; and
  4. If applicable, any other information or document that will help us locate your personal data.

 

The Universidad Panamericana will respond to your request within 20 (twenty) business days from the date it is sent and received. If the request is accepted, the Universidad Panamericana will make it effective within 15 (fifteen) business days following the date on which it communicates the response. If the information and/or documentation provided in your request is incomplete, erroneous and/or insufficient, or if the necessary documents to prove your identity or the corresponding legal representation are not provided, Universidad Panamericana will request the correction and correction of the deficiencies in order to process your request. You will have 10 (ten) working days to comply with the requirement and correct the request; otherwise it will be considered as not submitted.

 

The use of electronic means for the exercise of ARCO Rights authorizes Universidad Panamericana to respond to the corresponding request through the same means, unless you clearly and expressly indicate another means of contact in your request.

 

The right of cancellation is not absolute. Please note that Universidad Panamericana must retain information to comply with various legal obligations and may share your personal data with other entities or bodies in order to do so. In such cases, the right of erasure may need to be requested from the entity that received your personal data.

 

Do you want to revoke your consent?

 

In some cases, you may revoke your consent to the processing of your personal data; however, this revocation may not have retroactive effects, that is, it may not affect situations, procedures or transfers carried out before the revocation of your consent; nor in cases where such revocation involves the impossibility of fulfilling obligations arising from a legal relationship in force between you and the Universidad Panamericana, or involves the breach of general provisions of public order that establish the obligation to maintain the processing of your personal data for a certain period of time.

Limitations on the use and disclosure of your personal data

 

You may limit the use or disclosure of your personal data by directing the corresponding request to our Personal Data Department, following for such purposes the procedure and instructions applicable to the exercise of the ARCO Rights.

 

Universidad Panamericana has the means and procedures to ensure the inclusion of some of your personal data in its own exclusion lists, to prevent your data from being disclosed. In such cases, the Universidad Panamericana will provide the owners who request their registration with the corresponding registration certificate.

In order to improve the browsing experience of our users and for marketing analysis purposes, cookies and/or web beacons may be used on our website.

When it is legally appropriate and we have your email address, Universidad Panamericana may communicate changes to this Privacy Notice through that means of communication.
